Judge lifts competency stay in Fairbanks first-degree murder case

A judge has lifted the stay in a Fairbanks first-degree murder case that had been halted twice on questions of the defendant's competency to stand trial. Alaska CourtView records that a competency hearing was held on Monday, Oct. 5 at 2:30 p.m. in Courtroom 402 before Judge Brent Bennett, and gives the result as "Order on Competence. Stay Lifted."

The case is 4FA-26-00112CR, State of Alaska vs. Davenport, Brian Jeffery. It carries one count of murder in the first degree, intent to cause death, AS 11.41.100(a)(1)(A), an unclassified felony, offence-dated Jan. 20, 2026 at Fairbanks and recorded as domestic violence related. A grand jury indicted on the count on Jan. 29, 2026. He is charged, not convicted.

The court record shows the case was stayed on competency grounds twice before, by orders entered in April and in July, and that two confidential competency evaluations were filed, on July 7 and on Oct. 1. A competency hearing on Oct. 2 was continued to Monday. A docket entry dated Oct. 5 records findings and an order on competence for criminal proceedings, commitment and transport.

The contents of the order are not public and the court's event list shows no new trial date. Nothing in the court record describes the offence.

Fairbanks man charged with first-degree burglary and violating a protective order

The Alaska State Troopers dispatch for Oct. 4 records that troopers were dispatched at 8:53 a.m. to a report of a man violating a domestic violence protective order, that they determined he committed the crimes of violating a protective order and burglary in the first degree, and that he was arrested and remanded to the Fairbanks Correctional Facility. The trooper entry cited the burglary statute without a subsection; the charging document specifies burglary in a dwelling, which is the felony-class version of the offence.

A ninth Fairbanks case number stops returning records, and this one carried filed charges

A ninth Fairbanks criminal case number that appears in Alaska Court System records now returns No Records Found in Alaska CourtView, the court's public case lookup. 4FA-26-02006CR was searched twice by case number on the morning of Oct. 6 and returned no records both times, and a name search limited to cases filed since Sep. 1 also returned none.

The case was read in CourtView on Oct. 3. It was filed at Fairbanks on Oct. 2 and carried three counts, all offence-dated Aug. 7 at Fairbanks and all recorded as domestic violence related: assault in the fourth degree, recklessly injure, and two counts of assault when a child is present, all three Class A misdemeanours. Unlike the eight numbers already recorded, this one carried charges that had been filed rather than a count recorded as charging document pending.

The court's criminal dispositions report, which records cases that have closed, refreshed on Oct. 5 with a window running to that date. Alaska State Troopers responded with Steese EMS to Constitution Drive, Fairbanks, at about 12:40 a.m. on Monday, Oct. 5, for a medical assist. The dispatch states a person had collapsed and was unresponsive at home, that emergency intervention was unable to resuscitate them, and that they were pronounced dead at 1:14 a.m.

The dispatch records that nothing suspicious was noted and that the incident is considered closed. No name is published in the entry. The entry was posted at 1:51 a.m. on Oct. 6.

The dispatch states that the investigation determined he committed the offences of violating conditions of release and unlawful contact in the first degree, and that charges were forwarded to the District Attorney's Office for review.
