Three charges filed at the Nenana court over a domestic violence arrest at Healy

A criminal case was filed at the Nenana court on Sunday, Oct. 4 over a domestic violence arrest made at Healy the previous afternoon. Alaska CourtView records 4NE-26-00099CR, State of Alaska vs. Morimoto, Sho, with a status of Open.

The file carries three counts, all offence-dated Oct. 3, all with an offence location of Healy and all recorded as domestic violence related: assault in the fourth degree, cause fear of injury, AS 11.41.230(a)(3), a Class A misdemeanour; and two counts of assault when a child is present, AS 11.41.240(a), both Class A misdemeanours. No grand jury has heard the case; it proceeds on a complaint. He is charged, not convicted.

An arraignment was held on Oct. 4 at 1:30 p.m. in Courtroom 102 at the Fairbanks courthouse, before the weekend and holiday judge, with counsel appointed and conditions of release entered. A rural calendar call is set for Nov. 17 at 11 a.m. at the Nenana Courthouse. The case judge is Huisingh.

The charges match the offences recorded by Alaska State Troopers at the time of the arrest, which the dispatch entry of Oct. 3 gives as assault in the fourth degree and two counts of assault in the presence of a child, all domestic violence related. Nothing in the record describes the incident and nothing in it identifies any person recorded as a victim, or any child.

Healy has no court of its own hearing these charges: the Healy court has recorded no criminal filings for ten consecutive weeks, and Healy offences are charged at Nenana and, where a felony is involved, at Fairbanks.

Fairbanks man arrested on Sunday over a protective order violation and a burglary allegation

The Alaska State Troopers daily dispatch records that at 8:53 a.m. on Sunday, Oct. 4 troopers were dispatched to a report that Vincent Wright, 63, of Fairbanks was violating a domestic violence protective order. The dispatch states that troopers determined he committed the crimes of violating a protective order, AS 11.56.740, and burglary in the first degree, AS 11.46.300, and that he was arrested and remanded to the Fairbanks Correctional Facility. The entry was posted at 3:08 p.m.

No criminal court file exists for the arrest. The offences above are charges recorded by police, and no charge class is stated here, because none is on any court file. A search of Alaska CourtView under that name for cases filed between Oct. 1 and Oct. 5 returns one record and it is not a criminal case: a civil protective order filed on Oct. 2, which remains open. The Alaska Court System's weekly criminal charges report for the week ending Oct. 4 carries no case recording these offences.

Nothing in the record identifies any person recorded as a victim. He is arrested, not convicted.

A separate case under the same name, 4FA-26-02014CR, was filed on Oct. 3 and carries two counts offence-dated Oct. 2, both recorded as domestic violence related: assault in the fourth degree, cause fear of injury, a Class A misdemeanour, and criminal mischief in the fifth degree, a Class B misdemeanour. That case was arraigned at the same 1:30 p.m. calendar on Oct. 4. The two files carry different arrest tracking numbers and offence dates one day apart. Troopers appeal for witnesses to a single-vehicle collision on the Mitchell Expressway

Alaska State Troopers responded to a single-vehicle collision on the Mitchell Expressway at Airport Way at about 6:40 p.m. on Sunday, Oct. 4. The dispatch states the investigation is ongoing and asks anyone who witnessed the collision, or who has video of it, to contact the Alaska State Troopers at (907) 451-5100. The entry was posted at 9:33 p.m.

No arrest and no charge are recorded in the entry, and no injuries are described.

Alaska State Troopers received a report of a motor vehicle collision at about 6:36 a.m. on Saturday, Oct. 3. The dispatch states that a driver hit a moose while travelling southbound at mile 325 of the Richardson Highway, at Salcha, and records that no crime is suspected. No injuries are described.

The entry was posted to the Oct. 4 dispatch page at 10:15 p.m. on Sunday, about forty hours after the collision.

Eight Fairbanks-area case numbers printed by the court return no records in its public database

Eight criminal case numbers that appear in Alaska Court System records return No Records Found when searched in Alaska CourtView, the court's public case lookup. All eight were searched on the morning of Oct. 5.

One is new. 4FA-26-02018CR, a North Pole case filed and closed on Oct. 4 with one count recorded as charging document pending or not filed, was read in CourtView on Oct. 4 and returned records then. On Oct. 5 it returns No Records Found by case number, by a name search and by a name search limited to cases filed since Sep. 1. It is printed in the court's weekly criminal charges report for the week ending Oct. 4.

The seven already recorded are 4FA-26-01862CR, 4FA-26-01933CR and 4FA-26-01934CR, denied for a tenth consecutive day; 4FA-26-01904CR and 4FA-26-01984CR, for a fourth; and 4FA-26-02004CR and 4FA-26-02013CR, for a second. No charge is recorded against any of the eight.

No explanation for the eight is offered here. An earlier account - that a case closed for want of a charging document stops appearing in the public database - was withdrawn on Oct. 4 on the ground that one such case still appeared. That case is now among the eight, so the withdrawal no longer holds either, and none of the records available describes what has happened to these numbers.

The court's criminal dispositions report, which records cases closed, last refreshed on Oct. 1 and its window ends on that date, so it records nothing about the newer numbers.

The report run at 9 p.m. on Oct. 3 carried six and did not contain 4FA-26-02014CR anywhere in its 68 pages, although the court's own file date for that case is Oct. 3.

The two records now agree that seven criminal cases were filed at Fairbanks on Oct. 3. Readers of figures taken from the weekly report should treat a filing-day count as the count at the time the report was run: the report is produced each evening and has repeatedly added cases to days it has already published, including, in this instance, to its own filing day.
