Omnibus hearing continued in North Pole assault case; bail hearing set for Oct. 1

FelonyAlaska Court System

An omnibus hearing set for Sept. 29 in Superior Court in the case against Cody Steven Rudolph-Munro was continued, according to the court docket. A new omnibus hearing is set for Dec. 10, and the trial week of Oct. 12 has been reset.

A bail hearing is set for Oct. 1 at 3:45 p.m. before Judge Thomas I. Temple, following a defense application for a first bail review filed Sept. 28.

The case carries six counts dated Aug. 23 at North Pole, including assault in the third degree with a weapon, a Class C felony. The public record shows a change-of-plea hearing on Sept. 11 and a sentencing hearing on Sept. 15 but does not state their outcome. Rudolph-Munro is charged, not convicted.

Three felony methamphetamine counts filed against Fairbanks man; warrant requested

FelonyAlaska Court System

A complaint filed at Fairbanks on Sept. 28 charges Vitaliy P Gayvoronskiy with three counts of misconduct involving a controlled substance in the second degree, manufacture or deliver methamphetamine, each a Class A felony. All three counts are dated April 27, 2026, and all are at Fairbanks.

The court file records no indicted charge on any count, meaning the case is on a complaint and has not been heard by a grand jury. The docket carries two entries, both dated Sept. 28: the initial charging document, and a request for a warrant. No hearing has been calendared, no attorney is entered for the defendant, and the public record does not state that an arrest has been made.

A Class A felony is the most serious classified felony level under Alaska law, below only the unclassified felonies. The charges appeared in no police or trooper report; they were filed directly in court. Gayvoronskiy is charged, not convicted.

Warrant issued in five-count Fairbanks domestic violence case

MisdemeanorAlaska Court System

A warrant was issued by the Fairbanks court on Sept. 28 for Matthew Wayland Mayo Sr, whose case was filed on Sept. 25. The docket records the warrant as issued to the Alaska State Troopers. No hearing has been calendared.

The case carries five counts, all dated Sept. 9 at Fairbanks: one count of assault in the fourth degree, recklessly injure, recorded as domestic violence related, and four counts of assault when a child is present. All five are Class A misdemeanors.

The court record does not describe the incident and does not identify anyone as a victim. The case appears in no police or trooper report. Mayo is charged, not convicted.

North Pole arrest on an assault charge and a warrant from a 2024 theft case

MisdemeanorAlaska State Troopers

Alaska State Troopers went to a North Pole residence on Sept. 28 for a welfare check concerning reported elder abuse. Troopers reported that Cheala Shepherd, 24, of North Pole, had assaulted a household member, and that she had an active arrest warrant. She was arrested for assault in the fourth degree and on the warrant.

No court file existed for the assault as of early Sept. 29, so no charge class is stated here. A charge recorded by police is what an officer alleged; the charge class comes from the court file once one is filed.

The warrant is from a Fairbanks case filed in December 2024 charging one count of theft in the fourth degree, less than $250, a Class B misdemeanor, dated October 2024. That case remains open. Its record shows seven arraignments calendared through 2025, three of which ended with a failure to appear and a warrant, and warrants issued in April 2025, May 2025 and April 2026. Shepherd is arrested, not convicted.

Court file opens in Fairbanks DUI case that the public index had not shown; warrant issued

MisdemeanorAlaska Court System

A Fairbanks case number that the court's weekly report has been printing since Sept. 24, and for which the public case index returned no record on four consecutive days, now appears in that index. The case charges Stephen James Kellogg with driving under the influence and refusing to submit to a chemical test, both Class A misdemeanors, both dated Sept. 23 at Fairbanks.

The case status is recorded as reopened. A warrant was issued by the Fairbanks court on Sept. 28, and a hearing is calendared for Sept. 29. The court's separate dispositions report still records the same case number as closed on Sept. 24 with the charging document pending.

The sequence explains a pattern reported here earlier in the week: a case number is issued when a person is booked, the case can be closed if no charging document is filed, and it reopens and becomes visible in the public index when charges are filed. Kellogg is charged, not convicted.

State files sentencing memorandum in Fairbanks murder case; sentencing set for Nov. 6

FelonyAlaska Court System

The State filed its sentencing memorandum and notice under Criminal Rule 32.1 on Sept. 25 in the case against Cedar Mae Sarten, who was convicted on May 15, 2026 of two counts of murder in the first degree and one count of murder in the second degree. A fourth count was dismissed by the prosecution in June.

The filing follows the State's unopposed motion to extend the Rule 32.1 deadline, filed Sept. 4 and granted Sept. 9, and a presentence report filed Aug. 28.

A status hearing in Superior Court is set for Sept. 30 and sentencing for Nov. 6. Sentencing dates previously calendared for Sept. 30 and Oct. 1 are recorded as reset, vacated or calendared in error.

Five criminal cases filed at Fairbanks on Monday, three felony counts among them

FelonyAlaska Court System

The Alaska Court System's weekly charges report, generated at 9:01 p.m. on Sept. 28, records five Fairbanks filings for that day.

Three of the five have been reported separately: the three-count methamphetamine complaint against Vitaliy P Gayvoronskiy, the six-count domestic violence case against William Roger Burdo Jr, and the single weapons count against John William Kane.

Christopher Curtis Smith is recorded with a charging document pending, dated Sept. 28 at North Pole, and was released under the court's bail schedule. A hearing is set for Oct. 2. Court file 4FA-26-01941CR.

Erin Bartlett is charged with one count of improper use of registration, title or plates, an unclassified misdemeanor, dated Sept. 19 at Fairbanks. A hearing is set for Oct. 20. Court file 4FA-26-01948CR.

Court filings report adds four cases to a filing day three days after the fact

MisdemeanorAlaska Court System

The Alaska Court System's weekly criminal charges report now lists 17 Fairbanks cases filed on Friday, Sept. 25. The previous week's report, generated on Sept. 27, listed 13 under the same date.

The four cases added are each a single count of theft in the fourth degree, less than $250, a Class B misdemeanor, at Fairbanks, and each has a summons issued to the Alaska State Troopers on Sept. 28. Two are against Karl Timothy Thumma, for offenses dated July 4 and June 11. The others are against Dateen Duane Arkell, dated Aug. 21, and Eric Ezias John, dated Sept. 11.

The report is a rolling seven-day window generated nightly. Because it adds cases to earlier dates, a filing count for any day should be read as a minimum rather than a total.

The theft case against Dateen Duane Arkell is separate from the assault case against the same defendant filed on Sept. 27 and reported here. Everyone named is charged, not convicted.

Counsel enters in North Pole kidnapping case ahead of Oct. 1 hearing

FelonyAlaska Court System

The docket in the case against Dante Nathaniel Larry Claxton grew from seven entries to twelve on Sept. 28, with an attorney entering an appearance. The case judge is now recorded as Kirk F Schwalm.

The case carries three counts, all dated Sept. 22 and all recorded as domestic violence related: kidnapping, injury or sexual assault, an unclassified felony, at North Pole; and assault in the fourth degree and interference with a report of a domestic violence crime, both Class A misdemeanors, at Fairbanks. The case is on a complaint and information and has not been heard by a grand jury.

Preliminary hearings are set for Oct. 1 and Oct. 12. Claxton is charged, not convicted.

In a separate case, an attorney also entered an appearance on Sept. 28 in 4FA-26-01446CR against Alfred L Nelson, who was indicted Sept. 9 on one count of assault in the second degree, a Class B felony, recorded as domestic violence related. Arraignment is set for Sept. 30.

City police bulletin quiet for three days, with one late addition

Fairbanks Police Department

The Fairbanks Police Department daily bulletin returned no events for Sept. 27, Sept. 28 or Sept. 29 when read early Tuesday, with the date header confirmed on each reading. When read again Tuesday evening, Sept. 28 showed one event, the Old Steese Highway hit and run reported above. Counts for Sept. 21 through Sept. 26 were unchanged: 15, one, eight, five, one and two.

A zero on this feed means only that nothing had been posted at the time of reading. The bulletin covers the city of Fairbanks only, never carries death investigations, and does not cover North Pole, Nenana, Healy, Delta Junction or other trooper areas.

The Alaska State Troopers dispatch page for Sept. 28, covering the same region and the surrounding Interior, carried eight items when read Tuesday morning, up from seven the previous evening and two on Monday morning. The addition was the North Pole arrest reported above, posted at 6:41 p.m.
